Complaint

This edition included an interview about the Equality and Human Rights Commission鈥檚 proposed Code of Practice on how businesses should manage access to single-sex spaces.  A listener complained it 鈥渇alsely reported the nature of the EHRC guidance鈥. The ECU considered whether the programme met the 91福利社 Guidelines on accuracy.


Outcome

The EHRC submitted an updated Code for Government approval in September last year, reflecting the Supreme Court鈥檚 ruling on the definition of 鈥渟别虫鈥 for the purposes of the Equality Act 2010.  It has not yet been published but the 91福利社鈥檚 Social Affairs Editor, Alison Holt, had seen a copy and was interviewed to explain what it contained.   The complainant argued the focus on Trans people in the introduction to the item was misleading as the draft Code applied to everyone. In the ECU鈥檚 view however there was a clear editorial justification for focusing on a specific and controversial aspect of the proposals.  The ECU also considered a brief reference by the presenter to EHRC guidance becoming 鈥渓补飞鈥 was unlikely to have materially misled audiences given listeners were repeatedly told the Code constituted guidance.  The remark reflected the possibility of further changes to the proposed Code before it is accepted by the Government.
